Independent Evidence, Instructed by the Defence
When a defendant solicitor instructs the panel, the consultant’s duty is to the court, not to the instructing party. That duty is set out in CPR 35.3 and recorded in every report we sign.
Defence cardiology reports cover breach of duty, causation and condition, referenced to current NICE clinical guidelines and British Cardiovascular Society guidance. The panel accepts instructions from NHS Resolution, indemnity providers and defendant firms, including critique of the claimant’s cardiology expert witness report under CPR 35.6.
Instructions are accepted at NHS Resolution rates, with a quotation on the same working day. Publicly funded matters are handled at Legal Aid Agency rates where prior authority is obtained.
Six report types for defence cardiology.
Defence files typically need a breach of duty opinion, a causation opinion and a condition report. Where quantum is in issue, life expectancy and critique of the claimant’s cardiology expert witness report are also commissioned.
-
Breach of duty
Opinion on whether the cardiology care met the Bolam and Bolitho standard, referenced to current NICE clinical guidelines and British Cardiovascular Society guidance. CPR Part 35 compliant.
-
Causation
Whether any breach caused or materially contributed to the cardiac injury, on the balance of probabilities. Addresses but-for and material contribution where the medicine permits.
-
Condition & prognosis
Examination of the claimant and opinion on current cardiac status, functional capacity and likely future course — the foundation for quantum.
-
Life expectancy
Cardiac mortality opinion for quantum, referenced to peer-reviewed cardiac outcomes data.
-
Critique & rebuttal
The claimant cardiologist’s report tested on methodology, references and reasoning — used to inform questions under CPR 35.6 and the joint statement.
-
Joint statement
Structured discussion with the claimant’s expert under CPR 35.12. Areas of agreement and disagreement recorded, with reasons. Trial-ready document.
