Six standard sections in every report we prepare.
Every report follows the structure CPR Part 35 and Practice Direction 35 set out, and opens with the consultant’s declaration of duty to the court under CPR 35.3.
The core sections address breach of duty, causation, and condition and prognosis. Breach is tested against NICE clinical guidelines and ESC guidance for the relevant cardiac condition. Causation is assessed on the balance of probabilities, with reference to peer-reviewed cardiac outcomes literature.
Instructions come from claimant and defendant practices and publicly funded files, at Legal Aid Agency rates where applicable.

Expert’s declaration
Signed statement confirming the consultant’s overriding duty to the court under CPR 35.3, independence from the instructing party, and GMC Specialist Register entry in cardiology.

Breach of duty
Opinion on whether the cardiology care fell below the Bolam and Bolitho standard. Referenced against current NICE clinical guidelines and ESC guidance for conditions such as STEMI, AF and heart failure.

Causation
Assessment of whether the breach caused or materially contributed to the cardiac injury on the balance of probabilities. Addresses but-for and material contribution where the medicine permits.

Condition and prognosis
Current cardiac status, functional capacity, and likely future course. Includes echocardiography and cardiac MRI findings where relevant to the claim.

Literature and references
Full citation of the peer-reviewed cardiac outcomes data, NICE clinical guidelines and ESC guidance relied upon. Required under Practice Direction 35.

Signed conclusion
Clear, reasoned opinion on breach, causation and prognosis. Signed by the named consultant, with a statement of truth as required by CPR Part 35.
